User Licence Agreement

1. Acceptance of Terms

By accessing or using OpenAtlas’s deforestation monitoring services (“Services”), you (“User”) agree to this User Licence Agreement (“Agreement”). Please read these terms carefully. If you do not agree to these terms, you are not permitted to access or use the Services.

2. Licence Grant

OpenAtlas grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely to assess deforestation risk and compliance with applicable regulations, including the European Union’s Deforestation Regulation (EUDR).

3. Use Restrictions

You agree not to:

  • Attempt to reverse engineer, modify, or create derivative works of the Services, algorithms, or data outputs.

  • Use the Services to store or transmit any material that is unlawful, defamatory, or infringes on intellectual property rights.

  • Misuse the data provided, such as for purposes unrelated to deforestation monitoring and compliance.

  • Interfere with or disrupt the integrity or performance of the Services or associated data.

4. Data Privacy and Security

By using the Services, you consent to OpenAtlas’s handling of data in accordance with our Privacy Policy. OpenAtlas employs commercially reasonable measures to protect the security and integrity of data, but cannot guarantee absolute security. Users are responsible for ensuring compliance with relevant data protection laws in their jurisdictions when using or processing any data provided by the Services.

5. Disclaimer of Warranties and Limitations of Liability

The Services, including data outputs related to deforestation status or regulatory compliance, are provided “as-is” without any warranty as to accuracy or completeness. OpenAtlas does not guarantee uninterrupted access and is not liable for any reliance on the data for legal, financial, or environmental decision-making purposes. To the fullest extent permitted by law, OpenAtlas disclaims liability for any indirect, incidental, special, or consequential damages arising from the use of the Services.

6. Termination

OpenAtlas reserves the right to suspend or terminate access to the Services if the User violates this Agreement. Upon termination, you must immediately cease all use of the Services and delete any data obtained.

7. Compliance with Laws

User agrees to use the Services in compliance with all applicable laws and regulations. Users accessing data related to deforestation or environmental compliance for the European Union’s Deforestation Regulation must ensure the data’s lawful application in any regulatory filings or compliance assessments.

8. Governing Law

This Agreement is governed by and construed in accordance with the laws of the Netherlands. The competent courts of Amsterdam, Netherlands, will have exclusive jurisdiction over any disputes arising from this Agreement.

By using our services you confirm that you have read, understood, and agree to abide by these terms in accessing OpenAtlas’s Services.
